1. Introduction

RainyDayPal provides benefit bundling services by negotiating with insurance providers on behalf of employers and employees. We are not an insurance company; instead, we act as a platform that helps employers and employees access bundled coverage. These terms of service govern the use of our platform. By using the service you agree to these terms.

2. Eligibility

Users must be employers or employees participating through an employer.

3. Accounts & Access

Excluding initial enrollment, accounts, authentication, and session persistence are all handled through a third-party service. You are responsible for your login credentials. RainyDayPal is not responsible for losses due to unauthorized access if you fail to keep your credentials secure.

4. Services Provided

RainyDayPal bundles services from insurance providers for employers to provide to their employees. Each employer may have different options or configurations, and the amount paid directly by the employer will vary and may be based on a dollar amount, coverage amount, or percentage.

Our online platform allows users (both employers and employees) to view, edit, and submit their personal information, claims, and refund requests.

5. Use of The Service

RainyDayPal services must be used for lawful purposes only, any abuse of the platform will not be tolerated. You may not use the platform for unlawful, fraudulent, or unauthorized purposes, including attempting to gain unauthorized access to systems or data.

6. Payments and Billing

Invoices are currently handled manually and do not utilize a third-party service. In the near future, Freshbooks will take the place as the payment processor. Employers are responsible for failed payments. RainyDayPal is not responsible for delays, errors, or losses caused by third-party payment processors.

7. Insurance Policies & Coverage

The individual insurance policies included in bundles from RainyDayPal are governed by the insurance providers’ own terms. RainyDayPal is not responsible for policy limits or insurer actions.

8. Termination

RainyDayPal reserves the right to suspend or terminate access to its services. Every user has the right to stop using the services. RainyDayPal may retain certain information as required by law, regulation, or for legitimate business purposes (such as record-keeping and auditing).

9. Disclaimers & Limitation of Liability

There are no guarantees on uninterrupted or error-free service.

RainyDayPal is not liable for insurance coverage outcomes.

The services are provided ‘as is’ and ‘as available’. To the fullest extent permitted by law, RainyDayPal disclaims all warranties, express or implied, and limits its liability for any damages arising from the use of this platform.

10. Indemnification

Users agree to indemnify RainyDayPal against claims arising from misuse or violations.

11. Governing Law

These Terms are governed by the laws of Delaware, without regard to conflict of law principles.

12. Changes To Terms

These Terms of Service may be updated to better reflect the evolution and growth of the platform. All users, both employers and employees, will be notified of such changes.
